Bequests

Your Will directs how your estate is to be distributed and makes sure your wishes are honoured.

By making a bequest to UnitingCare Wesley Port Adelaide Inc you give the gift of a lifetime. A lasting, living memorial gift, extending beyond your lifetime allowing us to continue our work and to develop new and changing programs in response to community needs.

How much you leave in your Will as a gift depends on your own personal circumstances. Any amount, large or small, can help us enormously.

WHY SHOULD I HAVE A WILL?

Everyone should have a Will no matter how healthy or how wealthy. You make a Will to provide for those you love and for people who depend on you. A Will protects those people from unnecessary family conflict and expensive legal complications in the event of your death.

If you do not have a Will your assets will be distributed according to State Laws, which may not be what you wish.

HOW DO I MAKE A GIFT?

You can legally write your own Will but it is best to consult a solicitor or Trustee Company. They can ensure your wishes are properly expressed.

If you plan to make a Will, take the following steps. If you follow these steps you will then be ready to see your lawyer or Trustee Company.

  • List all of your assets together with any current loans or debts that you may have.
  • Think of the people and charities to which you wish to leave your assets (eg: furniture, house, money, jewellery).
  • Decide how you would like to have your assets distributed, ensuring always that your current loans and debts must be paid out before any of your assets are distributed.
  • Choose whom you would like to ask to be the Executor to carry out the wishes in your Will. Your Executor will ensure that your wishes are carried out according to your Will.

After you have seen your solicitor or Trustee Company and your Will has been executed you will need to:-

  • Arrange to keep your Will safe and secure (some lawyers and Trustee Companies offer to store your Will free of charge).
  • Remember to review your Will every few years as your circumstances may change and your Will may require updating.

 HOW DO I CHOOSE MY GIFT?

You can make a bequest to UnitingCare Wesley Port Adelaide Inc. by leaving:

  • A specific amount of money.
  • A percentage of your estate.
  • The residue of your estate after other distributions have been made.
  • Specific property including real estate, shares or works of art.
  • A life interest or reversionary bequest.

WHAT WORDING DO I USE TO MAKE MY GIFT?

A Specific Bequest

With a specific bequest you can leave a specific gift to UnitingCare Wesley Port Adelaide. The gift can be in the form of either an amount of money, a property, a work of art, an insurance policy, shares or anything else of value. If you wish to make a specific bequest your bequest must be worded as follows:-

"I give (insert the specific gift you wish to make) to UnitingCare Wesley Port Adelaide Incorporated of 70 Dale Street, Port Adelaide in the State of South Australia and I declare that the receipt of the Treasurer, Secretary or Public Officer for the time being is an absolute discharge to my Executors."

A Percentage Bequest

With a percentage bequest you can leave portions of your Estate among a number of beneficiaries without specifying specific items of property or amounts of money that are to be given. This gift allows for increases and decreases in the value of your total estate, If you wish to make a percentage bequest the following wording should be used:-

"I give (insert percentage) of the residue of my Estate to UnitingCare Wesley Port Adelaide Incorporated of 70 Dale Street, Port Adelaide in the State of South Australia and I declare that the receipt of the Treasurer, Secretary or Public Officer for the time being is an absolute discharge to my Executors of this gift."

A Residual Bequest

With a residual bequest you would firstly give either items and/or money to family and friends. The remainder of the Estate after these gifts have been made can then be left to UnitingCare Wesley Port Adelaide. If you wish to make a residual bequest the following wording should be used after making any specific bequest:-

"I give the residue of my estate to UnitingCare Wesley Port Adelaide Incorporated of 70 Dale Street, Port Adelaide in the State of South Australia and I declare that the receipt of the Treasurer, Secretary or Public Officer for the time being is an absolute discharge to my Executors of this gift."

A Life Interest or Reversionary Bequest

You may wish to leave property to a family member or close friend for their use during their lifetime. With a life interest or reversionary bequest the property will be given to UnitingCare Wesley Port Adelaide upon the death of the life tenant.

If you wish to make a life interest or reversionary bequest please use the following wording:-

"I give to (insert the name of the family member or friend) (insert either the address of the property or the specific amount of money you wish to give) for their use and occupation during their lifetime, they being responsible for the payment of all rates and taxes and levies in relation to the property and keeping the property insured for an amount and with an insurance company to the satisfaction of my Executors and upon their death to UnitingCare Wesley Port Adelaide Incorporated of 70 Dale Street, Port Adelaide in the State of South Australia and I declare that the receipt of the Treasurer, Secretary or Public Officer for the time being is an absolute discharge to my Executors of this gift."
